By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.
Account Creation: To access features like cloud storage and collaboration, you must create an account by providing a valid email address.
Account Security: You are responsible for safeguarding your account password and for all activities that occur under your account. We encourage you to use a strong password.
Unauthorized Access: If we detect or suspect unauthorized access to your account, we reserve the right to suspend it temporarily to protect your security and data integrity.
Expanded Features: We offer a paid membership plan, "Ohelo Studio Pro," for users who require unlimited projects, tracks, presets, collaboration, and high-quality audio exports.
Payment Processing: All payments are securely handled by our third-party payment processor, Stripe. We do not store your credit card information.
30-Day Guarantee: We want you to be satisfied. If you are not happy with your Ohelo Studio Pro subscription for any reason, you may request a full refund within 30 days of your purchase, no questions asked.
Discretionary Refunds: We may grant refunds beyond the 30-day window on a case-by-case basis. Our goal is your satisfaction with our service.
Ohelo Studio offers a generous free plan, including cloud storage and processing resources, on a Fair Use basis. We do this to support the creative community and lower the barrier to producing high-quality audio.
What is ‘Fair’? We consider "fair" to mean using our Services for their intended purpose—recording, editing, and mastering audio for projects of a reasonable scope. Our free plan is designed for individual creators and small projects.
If we notice an account is consuming resources (storage, bandwidth, processing) at a level that negatively impacts the experience of other users or incurs significant cost to us, we will reach out to discuss the situation. Activities like using your storage for general-purpose file hosting, creating an excessive number of projects, or automating processes in a way that strains our systems will prompt a conversation. Our goal is to work with you to find a solution, which may involve upgrading to a Pro plan or discussing a custom plan.
We are here to support creators. We ask that you be a good citizen of our platform, and we will reciprocate with a fair and flexible service.
You Own Your Content: You retain all ownership rights to the audio files, presets, and any other content you upload or create on Ohelo Studio ("Your Content"). We claim no ownership over it.
Your Responsibility: You are solely responsible for Your Content and for ensuring it complies with all applicable laws and these Terms.
You agree not to upload or create any content that is illegal, infringes on the intellectual property rights of others, or is otherwise malicious or harmful. This includes, but is not limited to, hate speech, harassment, or content that is illegal in the United States.
You also agree not to misuse the Services for activities such as spamming, crypto mining, or any activity that compromises the integrity or performance of our systems.
By You: You can stop using our Services at any time.
By Us: We reserve the right to suspend or terminate your account if you violate these Terms. In most cases, we will provide you with advance notice via email. However, in cases of severe misuse that threaten the stability of our platform or the security of other users, we may take immediate action without prior notice.
Data Backup: We strongly recommend you maintain your own backups of your audio files. While we take measures to protect your data, we are not responsible for any loss of Your Content.
Our platform and its original content (excluding Your Content), features, and functionality are and will remain the exclusive property of Ohelo Studio. Our service is protected by copyright, trademark, and other laws.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OHELO STUDIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES.
IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100.00) OR THE AMOUNT YOU PAID US, IF ANY, IN THE PAST SIX MONTHS FOR THE SERVICES GIVING RISE TO THE CLAIM.
The Services are provided on an “AS IS” and “AS AVAILABLE” basis. We do not guarantee that the service will be uninterrupted, secure, or free from errors. We disclaim all warranties, whether express or implied, including the warranties of merchantability, fitness for a particular purpose, and non-infringement.
We may modify these Terms from time to time. If we make changes that we believe are material, we will notify you by email or by posting a notice within the application. Your continued use of the Services after those changes become effective constitutes your agreement to the new Terms.
